  • El Salvador passes pioneering AI law to foster innovation and investment.
  • New AI law prioritizes open-source development and ethical standards.
  • The National Agency for AI was established to ensure ethical compliance and oversight.

El Salvador has recently moved towards legalizing artificial intelligence through the new regulation that supports the innovation of the technology while regulating . On February 28, the country’s National Bitcoin Office stated that the legislation had passed the parliament and placed AI as a focal technology in the nation’s development.

This new law outlines rules under which artificial intelligence can be researched and applied in the country. It is the world’s first national legislation that orients on the open-source AI development. This complements pieces of legislation like the Personal Data Protection Act and the Cybersecurity and Information security Act to formulate a system approach to AI development.

However, there is a conflict between the AI law and the Personal Data Protection Law, the AI law will apply. Although there is synergy between the two, the AI law will always take precedence over the data protection legislation to help advancing AI and facilitate its utilization.

The Government of President Nayib Bukele regards this measure as one of the key approaches to investment promotion and the development of high-tech industries. Parliamentarians are sure that the adoption of AI will bring great benefits to individuals, particularly the young professionals who are willing to contribute to the new age of the future world.

The new law means legal clarity for AI developers, protection even in the case of testing, stabilization, and full-scale application. It also has provisions against the abuse of AI technologies and it has approaches that deal with both closed technique or systems and with the new open-source process.

AI Labs and Innovation

One of the most important aspects of the legislation is a subject to further support of AI researches by means of creation of corresponding laboratories and innovation centers. These institutions will seek to incorporate AI solutions in relevant areas of public utility like traffic control, water resource tracking and geothermal energy efficiency.

Education and skills development of workforce are pivotal in the achievement of the law’s goals. This framework will provide institutions with advanced AI tools so as to establish a domestic talent pool of knowledge regarding the technology. This is towards the establishment of the country as an AI research and development center.

To counter the unethical use of AI, there is a necessity of establishing the National Agency for Artificial Intelligence (ANIA) by law. ANIA will provide guidelines for the AI development, act as a governing body that oversees compliance with ethical standards, and will be in charge of the National Registry of Artificial Intelligence Development. This registry is to monitor the artificial intelligence developers and provide a clear list of approved developers in the field.
